Q. What are the OHS laws?
A. The laws relating to OHS in NSW are outlined in both the
OHS Act 2000 and the
OHS Regulations 2001.
The difference between the two is that the Act is an Act of parliament -
the law for OHS in NSW, whilst the Regulations provide more detail about
certain elements of the Act such as high risk work.
Codes of Practice and
Australian
Standards provide even more specific detail about how work is to be
undertaken in a safe manner and relate to specific tasks, procedures or
industries.
Whilst Codes of Practice and Australian Standards are not legislation, the
legislation will refer to each from time to time to highlight best practice
(i.e. guideance for complying with the law).
Other relevant laws include:
1998 Workplace Injury Management and Workers Compensation Act
1987 Workers Compensation Act
